Trump May Have Survived, but Liberal Lawfare Continues against Conservative Groups
President Donald Trump famously fended off a barrage of state and federal charges in a notorious lawfare campaign to end his presidential bid. In typical Trump fashion, the attacks rolled off his back, but other conservative and Christian groups aren’t so lucky.
The attacks against Trump were reminiscent of the Lois Lerner scandal during the Obama administration. The IRS, under Lerner’s leadership, was caught targeting conservative groups, even searching up keywords used by right-leaning nonprofits to target them for audits.
Many were shocked by the brazenness of the IRS and later the prosecutors who went after Trump, but they shouldn’t have been surprised. Lawfare is a favorite tactic of the far-left, which has been targeting Christian cake bakers and florists for years. From nunneries to pre-schools to high school football coaches, no one has been safe from religious discrimination or lawsuits. In fact, America First Legal just reported that the Biden administration brought in a far-left group to train federal prosecutors how to go after conservative and Christian groups for “hate speech.” There are too many similar examples to list them all, but yet another is headed to the Supreme Court as of this week.
The justicesagreed this week to hear a case with the potential for major implications for protecting Christian and conservative groups from political targeting from the government.
In the case, First Choice Women’s Resource Centers v. Platkin, New Jersey Democratic Attorney General Matthew Platkin filed a subpoena in 2023 against the faith-based pregnancy resource center, First Choice.
Pregnancy resource centers have been the focus of political targeting and vandalism for years. That targeting ratcheted up after the Supreme Court overturned Roe v. Wade and returned the abortion issue to the states. When Platkin’s subpoena came in, it likely felt awfully familiar, especially since the subpoena demands extensive donor records from the pregnancy center, which can be a death sentence for a nonprofit.
Exposing donors to publicly attack, dox, or intimidate them is not a new tactic for political opponents. The pregnancy center, with help from Alliance Defending Freedom (ADF), sued to stop the subpoena, arguing they are being unfairly targeted for political reasons.
“New Jersey’s attorney general is targeting First Choice — a ministry that provides parenting classes, free ultrasounds, baby clothes, and more to its community — simply because of its pro-life views,” said ADF Senior Counsel Erin Hawley, vice president of the ADF Center for Life and Regulatory Practice. “The Constitution protects First Choice and its donors from unjustified demands to disclose their identities, and First Choice is entitled to vindicate those rights in federal court.”
The case focuses on some technical aspects in the pregnancy center’s legal challenge, specifically whether the state’s investigation must proceed further along before the center can file suit. But the high court could potentially also provide broader precedent on the merits of the case.
“The First Amendment protects First Choice’s right to freely speak about its beliefs, exercise its faith, associate with like-minded individuals and organizations, and continue to provide its free services in a caring and compassionate environment to people facing unplanned pregnancies,” Hawley added.
As groups without the budget or fame of the president face the same kind of lawfare, let’s resist the temptation to leave them alone to fight their own battles. This issue needs our prayers, for their sake, but also so that you or I are not the next target.
