Democrats Defy Election Laws as Swing States Keep Counting Ballots
With Election Day having begun and ended nearly two weeks ago, concerns over election integrity have passed out of the minds of most voters, but that isn’t stopping Democrats from trying to cheat. In Pennsylvania, Democrats and local officials are openly defying state law in an effort to hand Senator Bob Casey, Jr. (D) a fraudulent win. The Pennsylvania Supreme Court ruled in September, over a month before Election Day, that ballots cannot be counted if the envelope is not signed and dated, according to Section 3050(a.4) of the state’s Election Code. However, Democratic county election officials in Bucks County are disregarding the court’s ruling and counting unsigned and undated ballots as the state begins a recount for Pennsylvania’s contested seat in the U.S. Senate.
Bucks County Board of Commissioners Chairman Robert J. Harvie, Jr. (D) and Vice Chair Diane Ellis-Marseglia (D) announced last week that they would be counting unsigned and undated ballots, rejecting a motion by Commissioner Gene DiGirolamo (R) to uphold state law. “Precedent by a court doesn’t matter anymore in this country, and people violate laws anytime they want. For me, if I violate this law, it’s because I want a court to pay attention to it. There’s nothing more important than counting votes,” Marseglia said in open defiance of the Pennsylvania Supreme Court. She also acknowledged that Deputy County Solicitor Daniel Grieser had warned the Board that counting the unsigned and undated ballots was illegal.
The Republican Party of Pennsylvania immediately petitioned the state supreme court to intervene and block Democratic election officials in areas like Bucks County, Philadelphia County, and more from illegally counting ballots that the state legislature and Supreme Court have determined cannot be counted. “What’s taking place in these counties is absolute lawlessness, and America is watching,” fumed Pennsylvania Republican Party chairman Lawrence Tabas in a statement. “We will not rest and will do everything in our power to make sure the law is upheld and voter confidence remains intact.”
The Republican National Committee (RNC) has also become involved in the effort to halt county-level Democrats from illegally counting ineligible ballots. According to RNC Co-Chair Lara Trump, the RNC has filed lawsuits against the Bucks County Board of Elections. “This is a BLATANT violation of the law and we intend to fight it every step of the way,” Trump commented. RNC Chairman Michael Whatley said, “Let’s be clear about what’s happening here: Democrats in Pennsylvania are brazenly trying to break the law by attempting to count illegal ballots. They are doing this because they want to steal a [S]enate seat from” Republican candidate Dave McCormick. Whatley added, “The RNC has filed four lawsuits over this already and will fight for as long as necessary. This is the exact kind of left-wing election interference that undermines voter confidence.”
The Pennsylvania Supreme Court weighed in again Monday, insisting that all counties "including the Boards of Elections in Bucks County, Montgomery County, and Philadelphia County, SHALL COMPLY with the prior rulings of this Court in which we have clarified that mail-in and absentee ballots that fail to comply with the requirements of the Pennsylvania Election Code ... SHALL NOT BE COUNTED for purposes of the election held on November 5, 2024."
Decision Desk HQ and the Associated Press both called the race for Pennsylvania’s U.S. Senate seat for McCormick, who maintains an estimated 30,000 vote lead over incumbent Casey. However, Casey refused to concede the race, even after McCormick was invited to Senate orientation. “Across our commonwealth, close to seven million people cast their votes in a free and fair election. Our county election officials will finish counting those votes just like they do in every election,” Casey stated in a video posted to social media a week after Election Day. “I want to thank the election workers across our commonwealth who have been working diligently over this weekend. Their work will ensure Pennsylvania’s voices are heard,” he added. On Monday, the state began a recount process which officials warned could cost as much as $2 million. Under Pennsylvania law, Casey could waive the automatic recount but has refused to do so.
In comments to The Washington Stand, FRC Action Director Matt Carpenter commented on the Democrats’ efforts to fraudulently alter the election results. “Tens of millions in campaign spending from Democrat campaigns and aligned committees went into promoting the idea that Donald Trump and Republicans were ‘election deniers’ and ‘threats to democracy,’” Carpenter began. He continued, “By refusing to concede and brazenly counting disqualified ballots days after election day in an apparent attempt to flip the results of the Pennsylvania Senate race, Bob Casey exposes one of the main charges Democrats had against their opponents as nothing more than a power play.” He added, “If Democrats, like Casey, were actually committed to the democratic process they would respect the ruling from the Pennsylvania Supreme Court which made clear that mail-in ballots which lack signatures or proper dates cannot be included in final tallies and accept defeat.”
But the Keystone State isn’t the only area with election integrity issues. According to Minnesota Public Radio News, election judge Timothy Scouton has been arrested for allowing nearly a dozen people to cast their ballots in Hubbard County without any voter registration materials. Auditor Kay Rave reportedly found that Scouton allowed 11 individuals to vote without being registered to do so and without requiring them to register, even instructing his fellow election judges not to give the unregistered voters registration paperwork. He is currently facing two felony charges.
Conservatives have also raised concerns over Senate election results in Arizona. The race has been called for Democratic candidate Ruben Gallego, but the state voted overwhelmingly for President-elect Donald Trump. Both Gallego and his opponent, Republican candidate Kari Lake earned more votes than Trump’s opponent, Vice President Kamala Harris, and more votes were cast in total for the Senate race than for the presidential race. The popular Libs of TikTok account on X (formerly Twitter) noted on Sunday, “Third world countries count millions of ballots on election day. Florida counted nearly 11 million ballots on election day. The election was 12 days ago and we’re still counting ballots in California, Pennsylvania, Arizona, and North Carolina.” Lawyer and conservative pundit Rogan O’Handley commented, “How the hell does Arizona vote Trump by 6 points but pick cartel-linked Ruben Gallego as its Senator 5 days after the election? I’ll give you a hint. It’s fraud.”
