As Tensions Rise Between Trump and Biden, Electoral College Certification Receives Zero Objections from Dems

There are less than two weeks until Trump’s inauguration on January 20, and tensions between Trump and President Joe Biden appear to be on the rise.

For instance, Trump accused Biden on Monday of using executive orders to sabotage the upcoming presidential transition. This came after the president “banned offshore oil and gas drilling on the East and West coasts, the eastern Gulf of Mexico and parts of Alaska’s Northern Bering Sea.” Biden said in a statement Monday that his decision was made in light of what he believes is a “climate crisis [that] continues to threaten communities across the country.”

Trump quickly responded, stating that he wants to “unban it” upon taking office. “Biden is doing everything possible to make the TRANSITION as difficult as possible,” Trump posted on Truth Social. “[F]rom Lawfare such as has never been seen before, to costly and ridiculous Executive Orders on the Green New Scam and other money wasting Hoaxes. Fear not, these ‘Orders’ will all be terminated shortly, and we will become a Nation of Common Sense and Strength.” As the president-elect further emphasized during an interview with conservative radio host Hugh Hewitt, “It’s ridiculous. I’ll unban it immediately. I will unban it. I have the right to unban it immediately.”

While the relationship remains rocky between the president and the president-elect, the process of confirming the election results went smoothly within Congress. In Monday’s Electoral College certification, President-elect Donald Trump was formally deemed the official winner of the 2024 presidential election during the joint session of Congress. For many, this may not sound like breaking news. However, as the Daily Caller noted, this marks the first time within the 21st century that Democrats chose not to challenge the electoral college count of a Republican president. In fact, in a 312 to 226 vote, “there were zero objections to any state’s slate of electors.”

Not even Vice President Kamala Harris, who lost to Trump in the November election, put up a fight when certifying Trump’s electoral vote victory. In a video released prior to Monday’s meeting, Harris said it was her “constitutional duty as Vice President to certify the results of the 2024 election.” She added that “this duty is a sacred obligation — one I will uphold guided by love of country, loyalty to our Constitution, and unwavering faith in the American people.” Notably, before Monday, no elected Republican president since 2001 had managed to escape the objection of the Democrats.

To offer his insight on Monday’s seamless Electoral College certification, Family Research Council’s Matt Carpenter shared with The Washington Stand how “the Electoral Count Reform Act of 2022, which was signed into law by President Biden, made several reforms to the counting of the electoral college votes.” According to Carpenter, these reforms “hamstrung the tradition of Democrat members of Congress objecting to Republican electoral college victories.” In one regard, “it made the Vice President’s role purely ceremonial — so no longer can anyone claim the Vice President has the authority to reject a slate of electors.”

Additionally, Carpenter noted how the changes made in 2022 made it so that “the threshold for objections was raised from one senator and one representative to 20% of senators and 20% of representatives. If I had to venture to guess, I would say there were probably a few Congressional Democrats who voted for the Electoral Count Reform Act which now regret that vote and would have loved to have been able to object to the certification of Donald Trump’s second term as president.”
